Definition
【1】"Silicones Art (www.silicones-art.com)" means the online shop existing for selling products. (the "Company").
【2】"Buyers" means Members and Non-members who are granted the Services provided by the Company in accordance with this Agreement.
The Customer consist of the Members and non-members as follows：
a） "Member (buyer)" means anyone of the age of 18 or more is eligible to register as Member for the sole purpose of purchasing (including foreigners residing in rhis country) is entitled to use the Services provided by Silicones Art for the purchase of the Products. Do not use this website ff you are under 18 years old.
b）"Non-Member（buyer）" means any person who uses the Services provided by the Company without having registered itself as the Member.
【3】 "ID" means alphabets, numbers or certain combination of alphabets and numbers selected by the Member and registered by the Company for the identification of the Member.
【4】"Password" means any combination of alphabets and numbers selected by the Member and registered to the Company for the purpose of confirming the identity of the Member and protecting confidential information.
【5】"Business Day" means any day during which the Services are normally provided by the Company, which excludes Saturdays, Sundays and any public holidays.
Terms of use
In consideration of being permitted to access www.silicones-art.com (“Silicones Art”), and use Silicones Art website, I warrant that:

RELEASE OF LIABILITY AND INDEMNIFICATION

The terms of this release are contractual and not a mere recital. By agreeing to this release, I am agreeing that I cannot hold Silicones Art responsible for any injury that occurs as a result of this Website.
In consideration of being permitted to access and use this Website, and on behalf of myself and my personal representatives, heirs, and next of kin, I release, waive, discharge and agree not to sue Silicones Art its officers, directors and Moderators (hereinafter “Agents” ”), from all liability to myself or to my personal representatives, assigns, heirs and next of kin for all loss or damage, and any claim or damage, on account of injury to my person or property or resulting in my death, whether caused by the negligence of releasee or otherwise while I am accessing, viewing, reading or otherwise using the Website.
I agree to indemnify Silicones Art and each of them from any loss, liability, damage or cost company may incur due to my use of the Website, whether caused by the negligence of the Company or otherwise. I assume full responsibility for and risk of bodily injury, death or property damage due to negligence of Company or otherwise while I am accessing, viewing, reading or otherwise using Silicones Art.
I agree that this release, waiver, and indemnity agreement is intended to be as broad and inclusive as permitted by the laws of Malaysia and in full legal force and effect.
Being of lawful age, in consideration of being permitted to access and use of Silicones Art, I do for myself, my heirs, executors, administrators, and assigns, release and forever discharge Silicones Art, its Agents and their heirs, administrators, and executors of and from any and every claim, demand, action or right of action, of whatsoever kind or nature, either in law or in equity arising from or by reason of any bodily injury or personal injuries known or unknown, death and/or property damage resulting or to result from any accident which may occur as a result of my use of Silicones Art or any activities in connection with Silicones Art whether by negligence or not.
I explicitly agree that Silicones Art and its Agents may recover expenses incurred in defending any suit or arbitration, including reasonable attorneys’ fees and costs.
Buyer Protection and Secure Payment
Payment Security is one of our core values and in order to guarantee that, buyer can make payment through Online Transfer and PayPal . All payment transactions take place on the SSL Encrypted server. We won’t process your order until we can confirm that your payment information is legit and accurate. With all this systems in place we make sure that you and us are both safe.
Payment will be carried out according to the buyer´s choice of either direct debit, credit card, online banking，ATM cash deposit or pay by cheque. Silicones Art reserves the right to limit the method of payment chosen by the buyer depending on order value, shipment region or other objective criteria.You can pay with Paypal with its debit/credit card options, Visa, MasterCard, American Express. Both are the well-known secure payment channel for buyer and seller.
PayPal Payment System：

Online money transfers serve as electronic alternatives to traditional paper methods like checks and money orders. PayPal is a leader in antifraud technology. They use state-of-the-art technology to help prevent fraud, and their expert staff monitors transactions 24/7, enabling you to pay safely.
If you are an Existing Paypal account holder, you may just LOGIN and pay accordingly. However, if you are not a Paypal member, you can choose to pay using your Credit Card as visitor.
PayPal does not force you to register as a member.
IMPORTANT NOTE: Exisitng Paypal Members
We would advise you to update your latest address with Paypal accordingly before checking out. Shipping address has to be the same as the address recorded in Paypal system.
Payment option for Pre-order stock（customization order）
For Drop Shipping Pre-Order stock (customization order), Buyers have the choice to place a 60% security deposit. Because each product is custom made for each customer, the security deposit is non-refundable. The remaining 40% is due upon notice to the buyer of completion of the product.
Delivery, Completion of Transaction
A delivery period starts on the date immediately succeeding the date on which the deposit has been confirmed and ends on the date on which the delivery is completed
In the case of public holidays and other holidays or the occurrence of the natural disaster or the force majeure events, such period shall be excluded from the delivery period.
We reserve the right to reject any product(s) order you place with us, and/or or to limit quantities on any order, without giving any reason. If we reject your order, we will generally attempt to notify you using the e-mail address you gave us when you placed the order.
Customs Regulation and Inspections
If the country of the seller is different from the country of the buyer, the buyer is considered the importer of record and must comply with all laws and regulations of the country in which the buyer is receiving the goods.
Buyers should make sure that they can lawfully import the item into the buyer's country before purchasing the item.
Buyers may be subject to import duties and taxes, which are levied once a shipment reaches the customer's country. In principle, additional charges for customs clearance must be borne by you if not specified otherwise in the item detail page explicitly; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country.
Member's privacy is important to us, and we know you care how information about your order is used and shared. We would like our international buyers and sellers shipping products internationally to be aware that cross-border shipments are subject to opening and inspection by customs authorities.
Company may provide certain order, shipment, and product information--such as titles—to the international carriers, and such information may be communicated by the carriers to customs authorities to facilitate customs clearance and compliance with local laws. Customs authorities require us to state the value of the purchased item directly on the package. It is the responsability of the buyer to make sure that the product he bought is allowed in his country. We will not proceed to any refund if your product is confiscated by customs.
Member Rating and Review System
The review of the Products may be written by the Buyer, which, in principle, must be publicly disclosed. Any person who has written the review of the Products can delete the review prepared by himself or herself. In the event it is determined that the disclosed review of the Products and any attached opinion thereto are not appropriate for public disclosure, the Company is entitled to change or delete the relevant review and attached opinion. When the review of the Products is deleted, any opinion attached to such review is also deleted. The related detailed matters shall be posted on the relevant Services page. Company hereby reserves the right to take any appropriate legal action against any person who write the incorrect / abusive / false / untrue / defamatory product review and caused damaging credit of our company.
The Company is entitled to impose sanctions, such as deleting the relevant valuation results and disqualifying the relevant Member from using the Services, etc., if the Member has engaged in any activities in contravention of the purpose and objectives of the Member Rating and the assessment system
The Product review may be deleted or the relevant Member may be disqualified from using the Services in any of the following cases:
if engaged in any activities of insulting, causing defamation or damaging credit of our company, etc. through the Product reviews and any assessment results thereof.
Electronic Communications

You agree that is any information provided by you is false, inaccurate, obsolete or incomplete, we do not bear the responsibility of any loss or unexpected situation happen and that we may terminate your use of this site.

The product pictures are for illustration purposes and may or may not reflect the actual product due to customization and manufacturing processes.
Colors
We strive our best to display as accurately as possible the colors of products shown on the site. All photographs were taken at close proximity (variation in colors may occur due to different settings of monitor).
The product makeup is created at the hands of the best makeup artists, due to the characteristics of hand work on option makeup, there may be differ from each product compare with advertisement picture. Such reasons as asymmetry in makeup or details are not subjected for exchange, after service or refund.
However, videos shown on this site were recorded by our in-house videographer, what you see is what you get.
Availability, Errors & Inaccuracies
If an item is out of stock, it cannot be purchased. The depiction of the product package you order may differ from the product package that you receive.
This site’s acknowledgement of an order means that your order request has been received; it does not mean that your order has been accepted or shipped, or that the availability of an item has been confirmed. This site makes full efforts to describe and display its products and services accurately on the site. Despite these efforts, small number of the item on the site may be described inaccurately or be unavailable, and we may experience lags in uploading updates throughout this site and in our advertising on other sites. As a result, we do not guarantee the accuracy or completeness of the information, including product images, specification, availability and services. This site reserves the right to change or update information and to correct errors, inaccuracies at any time without prior notice. We apologize for any inconvenience caused.
Any merchandise not in stock will be updated by informing you to for re-order or purchase another same price product.
Delivery / Shipment
Ready Stock：we will ship out your item once we receipt the full payment.
Pre-order Stock（customization order）：
Because each product is handmade starting at the time the order is completed, production and delivery often takes between 15-25 days, but can take longer. The time to create a product by hand-finished can change due to availability of materials, the artist’s work reflecting buyer requests, and shipping time contingent on country, customs, and the consignment company. Estimated delivery time initially informed is not a guaranteed delivery time. In such cases, buyers will be notified of changes by Silicones Art.
We do our best to keep you involved in the process and send you order updates as soon as they’re available. (Photos can be provided at request.)
Once your custom order is ready for delivery, we will contact you to confirm the delivery date through email and a tracking number will be provided.
Risk of Loss
Ready Stock:
The risk of loss and title to products purchased on the site pass to the buyer and consignment company upon delivery. Silicones Art will try our best to help but take no responsibility for it.
Pre-order:
Customs department in each country and states often have regulation that should be investigated prior to placing orders; these may pertain to duty taxes and-or allowable items, it may be loss, damage or charge extra duty taxes during custom inspection and Silicones Art will try our best to help but take no responsibility for it.
If the product does not pass custom inspection, product will send back to manufacturer for second delivery.
It is the responsability of the Buyer to make sure that the product he bought is allowed in his country. We will Not proceed to any refund if your product is confiscated by customs.
Limitation of Liability
【1】www.silicones-art.com (“Silicones Art”) does not bear any responsibility for damages, no matter what the legal ground, in the case of deliberate action and gross negligence.
【2】Buyer are responsible for your own negligent use of our products. Using the product can involve physical activity and buyer assume the risks associated with engaging with physical activity with our product.
【3】We are not responsible for any injury that buyer may sustain using this product for whatever reason.
Quality Check
Maintenance of product quality is our services. Silicones Art reserve the right to quality check before items delivered out of store. As a result, packaging will be unsealed for the purpose. Defective packaging may occur upon shipment from overseas supplier. However, we warrant you that item sold is brans new product. Any further dispute on unsealed or defective packaging will not be accepted.
HEALTH AND SAFETY POLICY
Because of the nature of the product and because of the personalized choices of our buyers, therefore if you are not satisfied with your item due to the nature of the product we cannot accept returns/exchange based upon this. Please carefully select your item before purchasing so this doesn’t occur. Moreover, Silicones Art's products are intended for novelty and display purposes only, thus, Silicones Art will not be held accountable for any kind of injuries claimed upon use of our products.
The products are made-to-order and custom made just for you at manufacturer’s factory with the specific options you have chosen. Because your order is a custom product created just for you, once production of your product has begun your order may not be cancelled for any reason. we do not accept any order cancellation for any reasons; this includes cancellation during/after production. We do not give any refund for orders that have been already placed.
DISCLAIMER OF WARRANTY
This product is sold as is and without any warranties as to performance or merchantability. Our company follows the industry standard for our product. For obvious reasons of hygiene we can’t accept any return after usage. All sales are final and as is. This means there are no refunds, returns or exchange. The entire risk as to the quality and performance of the goods is with the buyer. If the items purchased from our company prove defective following their purchase, the buyer and not our company, assumes the entire cost of all necessary servicing and repair.
This product is sold without any expressed or implied warranties whatsoever. Because of the diversity of conditions under which this product may be used, no warranty or fitness for a particular purpose is offered. The buyer is advised to test the product thoroughly before using it. The buyer must assume the entire risk of using product.
once payment is received, the contract (order) cannot be cancelled without any exceptions.
However, rest assured that you will receive a quality product. For each product, we carefully follow a thorough quality check before shipping. We only send flawless products. We reject any product which does not pass all quality tests.
General Disclaimer
【1】Silicones Art's products are high simulation entities life-like mannequin doll for display. How to use this product, purely on the buyer’s self behavior. We are not responsible for buyer's actions after product sold.
【2】The mannequin dolls are not manufactured children's toys, we do not sell to underage person, please do not put in place where children can come into contact, do not use this product in public places except for commercial event purpose (such as exhibition). As a result of causing problems and disputes, the Company shall not responsible for it.
【3】All mannequin dolls are original works and does not involve any real portraits. But we can produced dolls individually according to buyer's requirements with reference to a real person to imitate or coated with makeup, once the dolls were sold, customers are advised not to display the mannequin doll in public places and internet with naked form. Any image rights arising problems or disputes, our Company is not responsible for it.
